First minimum-wage fine praised

Union leaders welcomed this month the first criminal prosecution of an employer for breaching minimum wage rules. Teresa Aguda, owner of Rascals Day Nursery, in Walthamstow, north-east London, was fined £2,500 after she admitted obstructing HM Revenue & Customs officials attempting to establish whether nursery workers received the national minimum wage.

Mrs Aguda, who was also told to pay £500 costs by Waltham Forest magistrates, was accused of preventing officers from accessing staff records. Brendan Barber, TUC general secretary, said: “The full force of the law should be used against employers who deprive their staff of their legal right to the minimum wage.” It is good to see Revenue & Customs take this tough line. It is simply not good enough merely to make employers pay employees what they should have been paid. They should be punished as well.’’ The government this year announced that businesses failing to pay the minimum wage of £5.35 an hour would face fines of £220 for each worker affected. Employers persistently flouting the law face personal fines of up to £5,000. Ministers also increased the budget to enforce minimum-wage rules by 50 per cent to £9m.Read more

GLA oversee the re-opening of Morecambe Bay Cockle Farm

The Gangmasters Licensing Authority (GLA) will be ensuring that licensed shellfish gangmasters meet the strict safety requirements that are needed when the Morecambe Bay cockle beds re-open in September.

It says plans are already in place, led by the Morecambe Bay Action Group, to ensure that the opening runs as smoothly as possible. Representatives of the North Wales and North West Sea Fisheries Committee, the Health and Safety Executive, Cumbria Police, the Maritime and Coastguard Agency, the Department for Work and Pensions and the GLA will be on hand. They will ensure all gatherers have the correct Sea Fisheries permits, oversee the health and safety of gatherers and their equipment and ensure only licensed gangmasters operate. The GLA assumes that some gangmaster will try to operate illegally as only five shellfish gangmasters currently hold licences. Paul Whitehouse, chairman of the GLA, says: "GLA actions will never eliminate the risk of another Morecambe Bay tragedy but we can significantly reduce the risk of this happening again by monitoring shellfish gangmasters and ensuring all reasonable precautions are taken."

Undermining the flexibility of temporary workers?

The CBI are calling for the government to resist EU moves to resurrect the draft Agency Workers Directive arguing that the directive, which proposes putting agency workers on an equal footing with permanent employees after just six weeks on assignment, will undermine the flexibility of temporary staff.

The call came as the two organisations revealed the findings of its survey of annual employment trends. It found that 58% of employers think the law would lead to a 'significant' cut in the use of temporary workers, 62% said the directive would damage flexibility, 65% said it would increase costs and 58% believed it would lead to more bureaucracy. Pertemps chairman, Tim Watts, believes that the government and the EU should focus their attention on the issue of illegal workers. He told Recruiter: "We have the problem of illegal immigrants and people from Europe who are in theory legal but choose to work illegally, ie cash in hand. The government doesn't know the extent of illegal workers in the UK; they have said it is half a million but I would put the figure at double that"...Read more

Eating for two? The perils of the office diet

The dietary habits of neighbouring work colleagues can have a drastic effect on your weight, according to a new survey.

More than three quarters of employees believe that gaining weight is the result of the unhealthy influence of the person who sits next to them in the office. The study of 2,000 workers also found that one in ten admitted they were driven to scoff chocolate or sweets when their desk buddy tucked into fatty foods; whilst 57 per cent said they ate their lunch earlier than planned because colleagues close by had started munching theirs. It is not just the behavioural eating habits of colleagues that is piling on the pounds but boredom. Allow Facebook at work, union tells bosses

Companies concerned about their staff using Facebook need to face up to the reality of modern living and instead issue clear guidelines on acceptable use of the site, one of the country's biggest unions warned today.

Three and a half million Britons are now members of the social networking site and according to research, a large number of them are young, middle-class professionals. A recent survey suggested that Britons spent an average of 3 hours 11 minutes on Facebook - nicknamed "Crackbook" because of its addictive nature - each month. Many firms, including the Metropolitan police, Transport for London, LloydsTSB, Credit Suisse and Goldman Sachs, have responded to the craze by banning employees from the site altogether. But the TUC said that with people spending more of their lives at work, it is inevitable that employees should contact friends or make plans for afterwards. The union said employers were within their rights to stop staff using the sites during the day, but believed that a total ban would be an "over-reaction."...Read more

Bosses in the dock as employment tribunal cases climb

The number of cases brought to employment tribunals in Great Britain in 2006-07 rose by 15 per cent, from 115,039 in 2005-06 to 132,577, according to official figures from the Tribunals Service.

The biggest rise comes in equal pay claims, showing a 155 per cent increase on 2005-06. The number of cases disposed of during 2006-07 also rose, by 19 per cent, from 86,083 to 102,597. Multiple cases now make up 60 per cent of all cases received, compared to 55 per cent last year and 36 per cent in 2004-05. Many cases involve more than one jurisdiction (complaint).

Of the 238,546 jurisdictions lodged in total in 2006-07:

  • Some 972 were age discrimination claims;
  • 44,013 were equal pay claims;
  • 44,491 claims were for unfair dismissal;
  • 28,153 were for sex discrimination (a large number of these were in conjunction with equal pay claims);
  • 3,780 were for race discrimination; and
  • 5,533 were for disability discrimination.

Employees 'want firms to go green'

Over half of UK office-based staff believe that their employer does not take environmental issues seriously, according to new research.

The findings, produced by recruitment consultancy firm Badenoch and Clark, also indicate that workers value such issues when choosing a new employer, with 40 per cent of workers citing recycling as the most important green credential of a company. Director at Badenoch and Clark Andy Powell commented: "Corporate social responsibility and 'green' credentials have become buzzwords in the business world over recent years. Increasingly, employees are demanding more from their employers when it comes to social and environmental issues. It is crucial for companies to look at their green policies when they are recruiting and to ensure they are in line with employee expectations”. The latest CIPD/KPMG Labour Market Outlook Survey suggested that many companies are failing when it comes to providing green transport options for their staff.

Drink and drugs 'hitting economy'

About 40% of employers feel that alcohol misuse is a major cause of absenteeism and poor productivity in the workplace, a survey suggests.

And the research by the Chartered Institute of Personnel and Development (CIPD) found that a third of firms believe drugs had a similar impact. More needed to be done by firms to rehabilitate those with drug and drink problems, the CIPD said. Days lost to drink costs industry about £2bn a year, government figures show. The CIPD research suggested that 22% of employers currently test staff for misuse of drugs and alcohol, with another 9% planning to introduce some form of testing. Almost a third of organisations said they had dismissed employees in the last two years due to alcohol problems. And more than a quarter said that they would report staff to the police if they were found to have used illegal drugs.
